~ f <br />'RESOLUTION N0. 85-8 <br />INTRODUCED BY: Mayor Carmen & Membex's -of Council <br />A RESOLUTION AUTHORIZING THE MAYOR <br />TO EXECUTE A CONTRACT WITH ATTORNEY <br />LOUIS H. ORKIN AS SPECIAL COUNSEL <br />TO ASSIST THE DIRECTOR OF LAW IN <br />DEFENDING THE MUNICIPALITY IN THE <br />WEISBERG LITIGATION AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the owners of certain property within the munici- <br />pality have commenced an action against the Village in the Cuyahoga <br />County Court of Common Pleas concerning the zoning classification of <br />the subject. property; and <br />WHEREAS, the Mayor and Council have determined that the <br />zoning issue raised in the aforesaid litigation is of prime importance <br />to the development of the Village; and <br />WHEREAS, the Mayor and Council have further determined that <br />it is in the best interests of the municipality to retain the services <br />of outside legal counsel to assist the Director of Law in defending <br />the municipality in the said litigation; now, therefore, <br />BE IT RESOLVED .BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Director. of Finance are hereby <br />authorized and directed to enter into a contract with Attorney Louis <br />H. Orkin to assist the Director of Law in defending the municipality <br />in Albert Weisberg, et al v Village of Mayfield in the Cuyahoga <br />County Court of Common Pleas. Attorney Louis H. .Orkin shall be paid a <br />fee in the amount .of ninety ,dollars ( $ 90 ) per hour f-or _ _ <br />services to be rendered at the request and under the direction of ..the <br />Director of Law. <br />Section 2. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at -open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compli- <br />ance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />Section 3. This Resolution is hereby declared to be an <br />emergency measure immediately necessary.for the preservation of the <br />health, safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reasons set forth in the preamble hereto. It shall therefore <br />take effect immediately upon passage by the affirmative vote of not <br />less than four (4) members elected to Council and approval by the <br />
