,~ <br />RESOLUTION N0. 83-5 <br />INTRODUCED BY: Mayor Beebe and Council as a Whole <br />A RESOLUTION AUTHORIZING PAYMENT TO <br />THE EARL IVES EQUIPMENT'C0. IN THE <br />AMOUNT OF FIVE THOUSAND ONE HUNDRED <br />NINETY SEVEN DOLLARS ($5,197.00) <br />FOR REPAIR OF THE LAYTON ROLLER AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Layton Roller owned by the municipality was <br />recently in need of repair; and <br />WHEREAS, the municipality has previously determined that <br />Earl Ives Equipment Co. is the only company in the geographic area <br />with the capability to competently repair the Layton Roller; and <br />WHEREAS, the municipality, in order to keep the afore- <br />mentioned equipment serviceable, contracted with Earl Ives Equipment <br />Co. for the repair of the said equipment; and <br />WHEREAS, the Mayor and Council are desirous of ratifying the <br />contract with Earl Ives Equipment Co. and are further desirous of <br />authorizing payment for the services rendered by said company in the <br />repair of the equipment; and <br />WHEREAS, the Mayor and Council do hereby determine that the <br />contract price of Five Thousand One Hundred Ninety Seven Dollars <br />($5,197.00) for the repair of the subject equipment is fair and <br />equitable;~now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Council of Mayfield Village do <br />hereby ratify the contract previously entered into with Earl Ives <br />Equipment Co. for the repair of the Layton Roller. <br />Section 2. The Council further determines that the <br />contract price of Five Thousand One Hundred Ninety Seven Dollars <br />($5,197.00) is fair and equitable and authorizes the Mayor and <br />Director of Finance to make payment in said amount for the services <br />rendered in repairing the subject equipment by the Earl Ives Equipment <br />Co. <br />Section 3 That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees,~resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements, including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />
