RESOLUTION N0. 83- 23 INTRODUCED BY: Councilman Fred N. Carmen A RESOLUTION AUTHORIZ ING THE PURCHASE OF A LEAF VACUUM ON AN EMERGENCY BASIS AND DECLARING AN EMERGENCY. WHEREAS, the Council has determined that it is in the best interests of the health, safety and welfare of the residents of Mayfield Village to purchase a leaf vacuum; and WHEREAS, the municipality has been able to obtain a favorable purchase price for such equipment with a delivery date that will permit its use during this Fall season; and WHEREAS, the Council has determined that the purchase of such equipment constitutes a true emergency and, therefore, should be made without the necessity of competitive bidding; now, therefore, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: Section Zs The Council authorizes the Mayor and Director of Finance to enter into a contract with Gibson-Stewart Co. in an amount not to exceed Six Thousand Three Hundred Dollars (56,300.00) for the purchase of a Giant-Vac leaf vacuum. The Council determines that such purchase constitutes an emergency for the reasons set forth hereinabove. Section 2= That the Council finds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements, including the requirements of Section 121.22 of the Ohio Revised Code. Section 3._ This Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the health, safety and welfare of the residents of Mayfield Village, Ohio, for the reasons set forth hereinabove. It shall therefore take effect immediately upon passage by the affirmative vote of not less than five (5) members elected to Council and approval by the Mayor or otherwise
