Resolution No. 9 45 <br />Introduced by: Mr. Busa <br />A RESOLUTION REJECTING BIDS FOR THE CONSTRUCTION OF <br />A BIKE PATH AND DECLARING AN EMERGENCY <br />WHEREAS, the Finance Director aE the Village has previously been authorized to <br />advertise for bids for the construction of a five-foot bike path on the east side of <br />SOM Center Road to be located between the south entrance of the Metropolitan Park <br />and extending to the south line of Metropark Drive Subdivision, a distance of approx- <br />imately 2,885 ft., and <br />WHEREAS, the Council has reserved the right to reject any and all bids, and <br />certain bids were received in response to such request for bids, now, therefore <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. All of the bids for the furnishing of labor and materials for the <br />construction of the five-foot bike path as previously referred to are hereby rejected <br />and the Clerk is hereby directed and instructed to return to the respective bidders <br />bid bonds deposited with the Village. <br />Section 2. The Finance Director is authorized to re-advertise for new bids <br />in accordance with plans, specifications and profiles which will be available to all <br />bidders at the office of Mayfield Village. <br />Section 3. Council declares this to be an emergency resolution necessary for <br />the preservation of the public peace, health and safety, such emergency arising out <br />of the necessity to reject all bids received and readvertise for bids, in order to <br />correct a situation now deemed undesirable; wherefore, this resolution shall take <br />effect and be in force from and after its passage and approval by the Mayor. <br />P.assed: July 19 , 1976 <br />Attest: <br />CLERK OF COUNCIL <br />A,p oved : <br />??. <br />I+IAYOR
