Defeated 3/21/77 <br />Resolution No. 978 <br />Introduced by: Mayor Beebe <br />A RESOLUTION AUTHORIZING AND DIRECTING SPIETH, <br />BELL, McCURDY & NEWELL CO., L.P.A. TO PROVIDE <br />MAYFIELD VILLAGE WITH A DEFENSE IN THE MATTER <br />OF JOSEPH PALERMO ET AL. VS. VILLAGE OF MAYFIELD, <br />CUYAHOGA COUNTY COMMON PLEAS COURT CASE #77-966659 <br />WHEREAS, litigation has been instituted by Joseph Palermo, Flossie Dixon and <br />Hobart Homes, Inc. against this municipality in the Cuyahoga County Common Pleas Court, <br />Case #77-966659; and <br />WHEREAS, Spieth, Bell, McCurdy & Newell Co., L.P.A. is presently counsel for <br />the Village in an action based upon similar facts filed by Dolores Myotte in the Court <br />of Common Pleas of Cuyahoga County, which action is now on appeal in the Court of <br />Appeals of this District, Case #36444; and, <br />WHEREAS, it is immediately necessary to provide for the defense of the muni- <br />cipality and the most recent litigation instituted is similar in nature to the matters <br />now on appeal; now, therefore <br />BE IT RESOLVED BX:THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Spieth, Bell, McCurdy & Newell Co., L.P.A. is authorized and directed <br />to act as counsel for this municipality in the defense of Court of Common Pleas of <br />Cuyahoga County Case #77-966659. <br />Section 2. Said law firm shall be paid at the rate of $55.00 per hour for <br />services rendered in connection with the defense of said litigation. <br />Section 3. Al1 invoices for legal services rendered pursuant to this Resolution <br />shall set forth time calculated to the nearest 1/10th hour. <br />Section 4. All necessary reasonable expenses incurred in the prosecution of <br />the defense on behalf of this municipality will be authorized to be_paid after being <br />approved by this counsel. <br />Passed: <br />PRESIDENT OF COUNCIL <br />Attest: <br />Approved: <br />MAYO R
