no action 1988 RESOLUTION N0. 88-42 INTRODUCED BY: Mayor Carmen & Council as a Whole A RESOLUTION AUTHORIZING THS MAYOR AND DIRECTOR OF FINANCE TO ACCEET A RIGHT-OF-WAY EASEti@7'P FR021 TRANSCON BUILDffi25 INCORPORATSD FOR THS PURPOSE OF CONSTRUCTING ANID MAINPAII3ING A TRAIrFIC SIGN POLS AND DECLARIIdG AN ffiKffiiGENCY WHEREAS, Transcon Builders Incorporated has offered to grant an easement to Mayfield Village for the purpose o£ constructing and maintaining a traEfic sign pole on its property in order to assure the continued flow of traffic through the area; and WHSREAS, the Mayor and Council of the municipality have expressed a desire to accept said easement £or the purpose hereinbefore mentioned; now, therefore, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: SECTION 1. The Mayor and Director o£ Finance are hereby authorized and directed to accept the grant of easement £rom Transcon Builders Incorporated for the construction and maintenance of a traffic sign pole provided that said easement is approved by the Director of Law and is in substantially the same form as that attached hereto and marked "Exhibit A." SECTION 2. The Council £inds and determines that all formal actions of this Council relating to the adoption of this Resolution have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 0£ the Ohio Revised Code. SBCTION 3: This Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the health, safety and welfare of the residents of Mayfield Village for the reason that the grant of easement is necessary in order for the municipality to assure the continued flow of traffic through the Village. It shall, therefore, take effect immediately
