RESOLUTION N0. 566 <br />By_ Mr. Belzer <br />Seconded by Mr. Mason <br />A RESOLUTION DECLARING IT NECESSARY TO IMPROVE <br />I,ANDER_ROAD BETWEEN,CERTAIN TERMINI IN THE <br />VILIAG_E OF .11AYFhELD BY CONSTRUCTING A SANITARY <br />SEv,IER WITH CURB_CONNECTION THEREFOR_ AND THE <br />NECESSARY_APPURTENANCES.AND,AECLARING AN EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF MAYFSEI~D, COUNTY OF CUYAHOGA AND <br />STATE OF OHIO, THREE-FOURTHS.OF AI,L MEMBERS ELECTED.THEFETO CONCURRING: , <br />Sec. ,1. It is necessary to improve Lander Road in the Village of Mayf field, <br />Ohio, from the existing sanitary sewer in Wilson Nlills Road southerly to the <br />southerly corporation line of the Villages of Mayffield and Highland Heights, by <br />the construction of a sanitary sewer, with curb connections. theref or, and the <br />necessary appurtenances, as shown on the plans hereinafter referred to, pre- <br />pared by the Village Engineer. <br />Sec. 2. It is hereby determined and declared that said improvement is <br />conducive to the public health, convenience and welfare of said Village and the <br />inhabitants thereof. <br />Sec. 3. That the grade of said street and improvement shall be the <br />grade as shown, by the Engineergs Plans and Prof files, which are made apart <br />hereof . <br />Sec. 4. That the Plans, spec if ications, estimates and pr of files of the <br />proposed improvement, heretofore prepared by the Engineer and now on file in <br />the office of the Clerk of this Council, are hereby approved. <br />Sec. 5. Inasmuch as said portion of Lander Road is the common bouridry <br />line between the Villages of Mayffield and Highland Heights and said Villages <br />have entered into an agreement in writing according. to law for the construction <br />of a sanitary sewer in bander Road as a joint improvement, each Village shall <br />pay 50% of the total cost of said joint improvement. It is further determined <br />that the whole of the Village of Mayffield*s share of the cost of said joint <br />improvement, less 2% thereof and the cost of improving the intersections, shall <br />be assessed in proportion to the benef its which-may result from the improvement <br />upon the following described lands and lots, to-wit: <br />All lots and lands in the Village of Mayffield <br />bounding and abutting upon the proposed improve- <br />ment between the termini aforesaid, <br />which said lots and lands are hereby determined to be specially benef fitted <br />by said improvement; and the cost of said improvement shall include the cost <br />of preliminary and other surveys, plans, speci.f ications, prof files and estimates, <br />and of printing, serving and publishing notices, resolutions, and ordinances, <br />the amount of damages resulting from the improvement assessed in favor of any <br />owner of land affected by the improvement and the interest thereon, the costs <br />
