<br />Sec. 1„ It is necessary to improve Ridgebury Boulevard in the Village
<br />of Mayfield, Ohio, from j+Tashington Boulevard Easterly to Orchard Heights Drive
<br />in the City of Mayfield Heights, by. the construction of a 12 inch, cast iron
<br />water main, with curb connections and appurtenances, as shown on the plans
<br />hereinaf ter ref erred to, approved by the Village engineer, and filed by the
<br />County Engineer, hereinafter called the "Engineer."
<br />Sec. 2. It is hereby determined and declared that said improvement is
<br />conducive to the public health, convenience and welfare of said Village and
<br />the inhabitants thereof.
<br />Sec, 3, 'T'hat the grade of said street and improvement shall be the grade,
<br />as shown by the Engineer's Plans and Prof Iles, which are made a part hereof..
<br />Sec. 4, That the plans, specifications, estimates and profiles of the
<br />proposed improvement, heretof ore prepared by the Engineer and now on f i1e in
<br />the off ice of the Clerk of this Council, are hereby approved, as is the estimate
<br />so filed by the Village Engineer as to the Village's and property owners share
<br />of the cost.
<br />Sec. 5. Inasmuch as said portion of Ridgebury Boulevard is a common
<br />boundary line between the Village of Mayfield and the, City of Mayfield Heights
<br />ana said municipalities have entered into an agreement in writing according
<br />to law for the construction of a water main in Ridgebury Boulevard as a joint
<br />improvement, each municipality shall pay 50% of the total cost of said joint
<br />improvement. It is further determined that. 85.85% of the Village of Hayfield's
<br />share of the cost of the water main and appurtenances and the whole cost of
<br />the curb connections shall be assessed in proportion to the benefits which
<br />may result from the improvement upon the following described lots and lands,
<br />to~wit;
<br />All lots and lands bounding and abutting upon the
<br />proposed improvement between the termini of oresaid,
<br />which said lots and lands are hereby determined to be specially benefitted
<br />by said improvement; and the cost of said improvement shall include the cost
<br />of preliminary and other surveys, plans, specifications, profiles and estimates,
<br />and of printing, serving and publishing notices, resolutions, and ordinances,
