i RESOLUTION N0. 88- 64 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />AUTHORIZING THE CLERR OF COUNCIL TO <br />ENDORSE THE ACCL+PTAPiCE OF AN EASErffiN'P FROM <br />JAMES T. RRIVANSK AND JANE M. RRIVANSK FOR THS <br />MAINTIIdANCE AND REPAIIZ OF A STORM SSWSR ON <br />PERMANSNT PARCffi. N0. 831-19-48 AND <br />DECLARING AN ElfIItGENCY <br />BE IT RESOLVSD BY THS COUNCIL OF MAYFIffi.D VILLAGE, OHIO, THAT: <br />SECTION 1. Mayfield Village, Ohio, hereby accepts an easement from <br />James T. Krivanek and Jane M. Krivanek for the maintenance and repair of a <br />storm sewer over, under, upon and across a certain portion o£ the premises <br />owned by the said James T. Krivanek and Jane M. Krivanek, a copy of said <br />? easement being attached hereto and incorporated herein as if £ully rewritten. <br />SECTION 2. The Clerk of Council is hereby authorized and instructed to <br />endorse the acceptance of such easement upon said easement and to £urther <br />endorse thereon the number and date of the passage of this Resolution. <br />SBCTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the pub3ic, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SBCTION 4. This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and welfare of <br />the residents of Mayfield Village for the reason that the easement accepted <br />herein will expedite the construction of improvements on the subject prem- <br />ises.
