FRED N. CARt4EN, <br />CUYAHOGA COUNTY COMMON PLEAS COURT, <br />THS AMOUNT NOT TO EFCCEED <br />Fzvs xaousnrm noLLnxs ($s,ooo.oo) nND <br />DSCLARING AN HPiIIiGSNCY <br />Wffi2EAS, Mayor Fred N. Carmen has been named as a Defendant in State of <br />Ohio v. Fred N. Carmen, the same being Case No. 234040, filed in the Cuyahoga <br />County Common Pleas Court; and <br />WHSREAS, the Law Director, after carefully examining all the facts and <br />circumstances, determined that the Mayor, in the performance of his duties, <br />acted with due caution and in good faith as well as in consultation with his <br />legal advisor; and <br />WHEREAS, the Mayor, as a result of his actions in his official capacity, <br />is entitled to legal representation, pursuant to the Charter and State law; <br />and <br />WBERRAS, the Law Director, pursuant to Article V, Section 4, o£ the <br />Charter of Mayfield Village, Ohio, has certified to the Mayor and Council <br />that he is unable to represent the Mayor in such matter; and <br />WHEItBAS, the Mayor and Council have £urther determined that it is in the <br />best interest o£ the Village as well as the Public 0£ficials in their per£or- <br />mance o£ their duties to retain the services of outside legal counsel. <br />NOW, THSREFORE, BE TT RESOLVSD by the Council of Mayfield Village, County <br />of Cuyahoga and State of Ohio, that: <br />SECTION 1: Thomas P. Gill is hexeby specifically employed as special <br />counsel in the matter of State of Ohio v. Fred N. Carmen, to take any and a11 <br />actions deemed necessary on behalf of the Mayor in this action, whereas for <br />such services Thomas P. Gill shall be paid in the amount not to exceed Five <br />Thousand Dollars ($5,000.00).
