DEV~LOP- <br />MENT C01~SPANY - .. _ <br />BE IT RESOLVED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA <br />COUNTY, , OIiIO, ..THAT : , _ -- ... -. _ <br />5eco 1. Council hereby approves the easement for the instal- <br />lation, maan aiming, operating, and repairing of a sanitary sewer in <br />certain land-owned by Worton Park Development Company and located on <br />property west of Int~,erstate Route 271 and east-.of Worton Park Drive <br />in Mayfield Village, given by Worton Park Development Company under <br />date of June__9, 1965. The Clerk is authorized to record said ease- <br />ment with the Recorder of Cuyahoga County only when there has been <br />submitted and filed with the Clerk a performance bond covering the <br />cost of construction of an~eight inch-sanitary sewer to be located <br />in the property described in-.said easement and also a maintenance <br />bond providing that Forest City Enterprises, Inc., will maintain said <br />sewer-if the Cuyahoga County Sanitary Engineer does not maintain it; <br />said bonds are to be approved,_by the Village Solicitors The Grantor <br />shall reimburse the Village for the cost of recording the ..easement. <br />The approval of this_._easement is for the sole purpose of permitting <br />the installation of said sanitary sewer in undedicated property and <br />does not constitute an acceptance of any dedication of any streets. <br />Sec.'2, This resolution is hereby declared to be an emergency <br />measure, necessary,.for the immediate preservation of the public peace, <br />health, safety, and- welfare of the Village of Mayf field and its <br />inhabitants, in order to provide necessary health facilities for land <br />adjacent to the property described in said easement, and this resolu- <br />tion shall go into effect immediately upon the date of its adoption. <br />Adopted this 21st-day of June, 1965. <br />~~ <br />t~ <br />~~ <br />~, <br />.%~ L~~? <br />Mayor - ress. en o ounce <br />Attest: <br />~ ,,... . <br />~, <br />EA er <br />
