RESOLUTION N0. 89-33 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />DECLARING NORTHERN OHIO PAVING COMPANY TO BE <br />THE LOWEST AND BEST BIDDER FOR THE RESURFACING OF <br />BONNIEVIEW DRIVE AND PORTIONS OF THE SOM CENTER BZKEWAY <br />WITHIN THE MUNICIPALITY, AUTHORIZING THE MAYOR AND PRESIDENT OF <br />COUNCIL TO EXECUTE A CONTRACT WITH NORTfERN OHIO PAVING COMPANY IN AN <br />AMOUNT NOT TO EXCEED THIRTY-THREE THOUSAND TfiREE FiUNDRED EIGHTY-SIX DOLLARS <br />($33,386.00), RESECTING ALL OTHER BIDS RECEIVED <br />AND DECLARING AN EMERGENCY <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. In accordance with the bids received, pursuant to advertise- <br />ment as required by law, Northern Ohio Paving Company is hereby declared to be <br />the lowest and best bidder for the resurfacing of Bonnieview Drive and <br />portions of the SOM Center Bikeway within the municipality. <br />SECTION 2. The Mayor and President of Council are hereby authorized and <br />directed to execute a contract with Northern Ohio Paving Company in an amount <br />not to exceed Thirty-Three Thousand Three Hundred Eighty-Six Dollars <br />($33,386.00) £or the aforesaid project, provided that said contract is in <br />accordance with the specifications upon which the bid was received. <br />SECTION 3. All other bids received are hereby rejected. <br />SECTION 4. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings o£ this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SEGTION 5. This Resolution is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of <br />Mayfield Village, Ohio, for the reason that the contract authorized herein <br />necessary to maintain an effective street repair program within the municipal- <br />ity to provide safe vehicular traffic.
