10/13/89 <br />RESOLUTION N0. 89- 6$ <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION <br />DECLARING ENZO CONSTRUCTION COMPANY, INC. TO BE <br />THE LOWEST AND BEST BIDDER FOR <br />ANITREE NORTI3 PHASE II DRAINAGE WORK, <br />AND REJECTING ALL OTHER BIDS AND <br />DECLARING AN EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. In accordance with bids received, pursuant to advertisement <br />as required by law, Enzo Construction Company, Inc., Inc. is hereby declared <br />to be the lowest and best bidder £or Aintree North Phase II drainage work. <br />SECTION 2. The Mayor and President of Council are hereby authorized <br />and directed to enter into a contract with Enzo Construction Company, Inc., in <br />an amount not to exceed Ninety-Five Thousand Three Hundred Ten Dollars <br />($95,310.00) for the aforesaid project provided that said contract is in <br />accordance with the speci£ications upon which the bid was received. <br />SECTION 3. All other bids received are hereby rejected. <br />SECTION 4. The Council finds and determines that all formal actions o£ <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings of this Council; and that deliberations of this Council and of <br />its camnittees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 5: This Resolution is hereby declared to be an emergency measure <br />necessary £or the immediate preservation of the health, safety and welfare <br />of the residents of Mayfield Village, Ohio, for the reason that the contract <br />authorized herein is necessary to maintain the proper storm water drainage <br />throughout the Municipality. It shall, therefore, take effect immediately
