AMENDED 12/18/89 <br />RESOLUTION N0. 89-85 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />GRANTING A SPECIAL U-6 USE PERMIT TO <br />MAYFIELD UNITED METHODIST CHURCA TO USE CERTAIN <br />PREMISES FOR A DAY CARE CENTER <br />FOR A PERIOD OF THREE (3) YEARS <br />AND DECLARING AN EMERGENCY <br />WHEREAS, Mayfield United Methodist Church, has requested that certain <br />premises located at 810 SOM Center Road be used for a day care center; and <br />WIIEREAS, the said premises are located within a use district zoned for <br />single-family residential use; and <br />WHEREAS, the Mayor and Council acknowledge that, pursuant to the provi- <br />sions of Section 1149.02 of the Codified Ordinances of Mayfield Village, <br />entitled "Use District Exemptions," the Class U-6 use may be permitted in any <br />use district; and <br />WFIFREAS, on November 16, 1989, the Planning and Zoning Commission recom- <br />mended to Council that a special permit be granted to Mayfield United Method- <br />ist Church to operate a day care center in compliance with certain conditions; <br />and <br />WHEREAS, it has been determined by Council that such use would substan- <br />tially serve the public convenience and welfare and will not substantially or <br />permanently injure the appropriate use of the neighboring property; and <br />WHEREAS, the Mayor and Council is desirous of granting a special use <br />permit to Mayfield United Methodist Church to operate a day care center in <br />compliance with certain conditions; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. Council finds that the use of the property located at 810 SOM <br />Center Road as a day care center will substantially serve the public conve- <br />nience and welfare and will not substantially or permanently injure the <br />appropriate use of the neighboring property, and further that such use will <br />not be injurious, obnoxious or offensive by reason of omission of refuse <br />water, odor, dust, fumes, vibrations, smoke, gas, noise, or otherwise and will <br />not be dangerous or harmful to life, health, property or morals and will not <br />cause undue congestion on the public highways.
