1L/ia/ay <br />RESOLUTION N0. 89- $6 <br />INTRODUCED BY: Mayor Carmen and Council as a Whole <br />A RESOLUTION <br />REQUESTING THE CUYAHOGA COUNTY TREASURER <br />TO ADVANCE TAXES FROM THE PROCEEDS OF TAX LEVIES <br />FOR COLLECTION YEAR 1990, <br />AND DECLARING AN EMERGENCY <br />WHEREAS, Section 321.34 0£ the Ohio Revised Code provides that money in a <br />County Treasury to the account of a local authority and lawfully applicable to <br />the purpose of the current fiscal year may be withdrawn by a municipality upon <br />proper request; and <br />WHEREAS, the Council has £ound and determined that sound fiscal policy <br />requires that such withdrawal be requested from the Cuyahoga County Auditor <br />and the Cuyahoga County Treasurer; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. The Cuyahoga County Auditor be and is hereby requested to <br />draw warraftts and the Treasurer of Cuyahoga County be and is hereby requested <br />to pay the Village of May£ield all monies presently being held in the Cuyahoga <br />County Treasury to the account of the Village of May£ield, lawfully applicable <br />to the purpose of the fiscal year 1990. <br />SECTION 2. The Clerk be and is hereby authorized and directed immediate- <br />ly to forward copy of this Resolution to the Cuyahoga County Auditor and the <br />Cuyahoga County Treasurer. <br />SECTION 3. The Council finds and determines that all formal actions of <br />this Council relating to the adoption of this Resolution have been taken at <br />open meetings o£ this Council; and that deliberations of this Council and of <br />its committees, resulting in such formal action, took place in meetings open <br />to the public, in compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the health, safety and welfare <br />of the residents of May£ield Village, Ohio, for the reason that the monies <br />requested herein are necessary to maintain essential governmental services.
