RESOLUTION N0. 87-25 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION ACCEPTING A TEMPORARY RIGHT-OF-ENTRY <br />GRANTED BY THE MAYFIELD BOARD OF EDUCATION FOR THE <br />PURPOSE OF COMMENCING AND COMPLETING THE WILSON <br />MILLS RECONSTRUCTION PROJECT AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Mayfield Board of Education has recently <br />authorized the grant of a temporary right-of-entry to Mayfield Village <br />for the purpose of commencing and completing the Wilson Mills Road <br />Reconstruction Project; and <br />WHEREAS, the municipality is desirous of accepting said <br />temporary right-of-entry for the purposes therein mentioned; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Mayfield Village does hereby accept the <br />temporary right-of-entry granted by the Mayfield Board of Education <br />for the commencement and completion of the Wilson Mills Reconstruction <br />Project over and across certain property owned by the said Board of <br />Education, a copy of said right-of-entry being attached hereto, marked <br />Exhibit "A" and incorporated herein as if fully rewritten. <br />Section 2. The Mayor and President of Council are hereby <br />authorized and directed to endorse the acceptance of the said <br />temporary right-of-entry as provided therein. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compli- <br />ance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />Section 4. This Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />health, safety and welfare of the residents of Mayfield Village for <br />the reason that the temporary right-of-entry granted herein is <br />necessary to commence and complete a construction project that is <br />necessary for the free flow of traffic within the municipality. It <br />shall therefore take effect immediately upon passage by the affirma- <br />tive vote of not less than four (4) members elected to Council and <br />
