RESOLUTION N0. 87-37 INTRODUCED BY: Mayor Carmen and Council as Whole A RESOLUTION ESTABLISHING TERMS, CONDITIONS, AND COMPENSATION FOR THE SERVICES OF THE PROSECUTOR, REPEALING RESOLUTION N0. 87-31 AND DECLARING AN EMERGENCY, WHEREAS, the Council of Mayfield Village, Ohio, adopted Resolution No. 87-31 on April 20, 1987; and WHEREAS, the said Resolution No. 87-31 contained a typo- graphical error designating the hourly rate of pay for the Prosecutor as Seventy Dollars (570.00) when, in fact, the hourly compensation should have been Seventy Five Dollars (575.00) per hour; and WHEREAS, the Mayor and Council of the municipality have further determined that the annual base compensation of the Prosecutor should be increased to Ten Thousand Eight Hundred Dollars (510,800.00) annually; now, therefore, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: Section 1. The Mayor's appointment of Vincent A. Feudo as Prosecutor for Mayfield Village, Ohio, is hereby confirmed subject to the terms, conditions and compensation hereinafter established. Section 2. Effective January 1, 1987, and retroactive thereto, the Prosecutor shall be compensated at the rate of Ten Thousand Eight Hundred Dollars (510,800..00) annually for all services rendered to the municipality in such capacity except as herein otherwise provided. While in attendance at all trials and pretrials in the Lyndhurst Municipal Court on criminal charges brought by Mayfield Village either under its own Codified Ordinances or under the Revised Code of the State of Ohio, and including preliminary hearings in the Lyndhurst Municipal Court on felony charges arising out of Mayfield Village, the Prosecutor shall be compensated at the rate of Seventy Five Dollars (575,00) per hour, payable upon submission of reasonably detailed billings indicating the name of the case, the date and nature of the proceeding and the time spent, Section 3. This contract shall be effective until December 31, 1987 or until the appointment of a successor Prosecutor, whichever is later, provided that either party may cancel this contract upon providing thirty (30) days written notice to the other. Section 4. The Prosecutor shall be responsible directly to the Mayor and shall not be under the supervision or control of the Director of Law. section 5. Resolution No. 87-31 is hereby repealed in its entirety.
