RESOLUTION N0. 87- 41 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />A RESOLUTION AUTHORIZING ADDITIONAL REPAIRS TO THE <br />YOUNG PUMPER OWNED BY HAYFIELD VILLAGE BY J&D FIRE <br />EQUIPMENT REPAIR, INC. IN AN AMOUNT NOT TO EXCEED <br />SEVEN THOUSAND DOLLARS ($7,000.00), DECLARING THE <br />SAME TO BE A TRUE EMERGENCY AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the municipality has previously authorized J&D Fire <br />Equipment Repair, Inc. to perform certain repairs on the Village owned <br />Young Pumper; and <br />WHEREAS, a certain dispute has arisen between the <br />municipality and J&D Fire Equipment Repair, Inc, concerning the <br />repairs previously made; and <br />WHEREAS, the municipality and J&D Fire Equipment Repair, <br />inc. have reached an agreement whereby additional repairs will be made <br />to the vehicle for a sum not to exceed Seven Thousand Dollars <br />(57,000.00); and <br />WHEREAS, the additional repairs will enable the vehicle to <br />meet NFPA standards which the original specifications prepared by the <br />municipality did not require; and <br />WHEREAS, the additional repairs authorized herein will <br />enhance the firefighting capability of the municipality; and <br />WHEREAS, for the reasons set forth hereinabove the contract <br />authorized herein is declared to be a true emergency thereby <br />eliminating the requirement of competitive bidding for same; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and President of Council are hereby <br />authorized and directed to execute an agreement with J&D Fire <br />Equipment Repair, Inc, for additional repairs to be made to the <br />Village owned Young Pumper in an amount not to exceed Seven Thousand <br />Dollars (57,000.00), with the repairs to be made set forth in the <br />letter attached hereto, marked Exhibit "A" and incorporated herein as <br />if fully rewritten. <br />Section 2. This Resolution is hereby declared to be a <br />true emergency for the health, safety and welfare of the residents of <br />Mayfield Village, Ohio for the reasons set forth hereinabove and, <br />therefore, the requirement of competitive bidding is not required. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />_ formal action, took place in meetings open to the public, in <br />
