RESOLUTION N0. 87- 75 <br />INTRODUCED BY: Mayor Carmen & Council as a Whole <br />r~ A RESOLUTION URGING THE OHIO GENERAL ASSEMBLY TO <br />ENACT APPROPRIATE LEGISLATION PERTAINING TO <br />AUTOMOBILE TAIL PIPE INSPECTION AND MAINTENANCE IN <br />ORDER TO AVOID SANCTIONS IMPOSED BY THE FEDERAL <br />GOVERNMENT. <br />WHEREAS, the federal government has expressed its intent to <br />impose sanctions against Cuyahoga County unless the State of Ohio <br />enacts legislation to implement a tail pipe inspection and maintenance <br />program; and <br />WHEREAS, the sanctions would include the loss of approxi- <br />mately Twenty Four Million Dollars (524,000,000.00) in federal highway <br />funds; and <br />WHEREAS, the loss of such funds would place additional <br />burdens on state and local budgets; and <br />WHEREAS, the United States Environmental Protection Agency <br />has determined that legislation for a tail pipe testing program is <br />necessary to ward off the implementation of sanctions; and <br />WHEREAS, the Mayor and Council of Mayfield Village, Ohio, <br />have determined that the Ohio General Assembly should enact the <br />appropriate legislation to prevent the imposition of sanctions; now, <br />therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The f9ayor and Council of Mayfield Village, <br />Ohio, for themselves and on behalf of the employees and residents of <br />Mayfield Village urge the Ohio General Assembly to enact legislation <br />necessary to implement a tail pipe inspection and maintenance program <br />in order to avoid the imposition of sanctions by the federal <br />government. <br />Section 2. The Clerk of Council is hereby authorized and <br />directed to forward duplicate copies of this Resolution to Governor <br />Richard F. Celeste and to the Cuyahoga County Delegation to the Ohio <br />General Assembly. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />
