RESOLUTION N0. 87-$4 <br />INTRODUCED BY: Mayor Fred N. Carmen <br />A RESOLUTION RATIFYING THE AUTHORIZED EXTRA <br />EXPENDITURES IN THE CONTRACT PREVIOUSLY AWARDED TO <br />TAE HORVITZ COMPANY FOR TAE RESURFACING OF CERTAIN <br />STREETS WITHIN THE MUNICIPALITY, AUTHORIZING THE <br />DIRECTOR OF FINANCE TO PAY SUCH AUTHORIZED EXTRA <br />EXPENDITURE AND DECLARING AN EMERGENCY. <br />WHEREAS, the Council of Mayfield Village, Ohio, has <br />previously adopted Resolution No. 87-51 declaring The Horvitz Company <br />to be the lowest and best bidder for the resurfacing of certain <br />streets within the municipality and rejecting all other bids received; <br />and <br />WHEREAS, the aforesaid Resolution further authorized the <br />Mayor and President of Council to execute a contract with The Horvitz <br />Company in an amount not to exceed Two Hundred Seventy Six Thousand <br />Nine Hundred Twenty Five Dollars (8276,925.00) for the aforesaid <br />construction project; and <br />WHEREAS, following commencement of the said construction <br />project the municipality, with the recommendation and approval of the <br />Village Engineer, authorized extra additional work in the amount of <br />Ten Thousand Two Hundred Seventy Dollars and Seventy One Cents <br />(810,270.71); and <br />WHEREAS, the Council of Mayfield Village is desirous of <br />ratifying the aforementioned informal approval for extra work in the <br />amount stated; now, therefore, <br />BE IT RESOLVED BY TAE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The contract previously executed with The <br />Horvitz Company pursuant to Resolution No. 87-51 is hereby increased <br />for extra work performed by said contractor in the amount of Ten <br />Thousand Two Hundred Seventy Dollars Seventy One Cents (810,270.71). <br />Section 2. The Director of Finance is hereby authorized <br />and directed to make payment to The Horvitz Company in the extra <br />additional amount authorized herein. <br />Section 3. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Resolution have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the requirements <br />of Section 121.22 of the Ohio Revised Code. <br />
