06/15/89 , ORDINANCE N0. 89- 25 ?'-- INTRODUCED BY: MAYOR CARMEN AND THE ENTIRE COUNCIL. AN ORDINANCE REPEALING CODIFIED ORDINANCE SECTION 1157.05 PERTAINING TO THE CREATION OF A DISTRICT KNOWN AS U-3AA, RESTRICTED MULTI-STORY APARTMENT HOUSE DISTRICT, AND REPEALING ALL ORDINANCES INCONSISTENT HEREWITH WHEREAS, the Council of Mayfield Village, Ohio, has previously enacted Ordinance No. 721 on January 16, 1961; and WHEREAS, the aforesaid Ordinance is codified in 1157.05 of the Codified Ordinances of Mayfield Village, Ohio, establishing the Restricted Multi-Story Apartment House District; and WHEREAS, no land has been used for such purpose and Council now wishes to prohibit buildings or premises to be used in such manner; now, therefore, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: ' SECTION 1. Existing Section 1157.05 of the Codified Ordinances of Mayfield Village, Ohio, entitled "Restricted Multi-Story Apartment House District," incorporated herein and attached hereto and marked as "Exhibit A," is hereby repealed in its entirety. SECTION 2. All prior Ordinances inconsistent with this Ordinance, in whole or in part, are repealed to the extent necessary to avoid conflict with this Ordinance. SECTION 3. The Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code. SECTION 4. The Clerk of Council is hereby authorized and directed to certify a copy of this Ordinance to the Cuyahoga County Board of Elections for approval or rejection by the electorate of Mayfield Village, Ohio, pursuant to Article III, Section 13, of the Charter of Mayfield Village, Ohio, and directs ?)
