AMENDED 09/12/•89 <br />ORDINANCE N0. 89-33 <br />INTRODUCED BY: Mayor Carmen and the Entire Council <br />AN ORDINANCE <br />ENACTING NEW CHAPTER 749 OF THE CODIFIED <br />ORDINANCES OR MAYFIELD VILLAGE FOR <br />REGULATION OF RECOVERY COSTS <br />FOR EMERGENCY ACTIONS <br />WHEREAS, the State of Ohio recently enacted Section 3745.13 of the Ohio <br />Revised Code which provides a mechanism or municipal corporations to recover <br />costs expended for dealing with unauthorized spills, releases, or discharges; <br />now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />SECTION 1. New Chapter 749 of the Codified Ordinances is hereby enacted <br />to read as follows: <br />"Chapter 749. Recovery Costs for Emergency Actions. <br />749.01 Purpose and Scope <br />The purpose of this chapter is to provide for compensation to the <br />Village for costs incurred in investigating, mitigating, minimizing, <br />removing or abating unauthorized spills, releases or discharges of <br />materials into or upon the environment within the territorial jurisdic- <br />tion or responsibility of the Village of Mayfield, and which spills, <br />releases or discharges require emergency action to protect the public <br />health or safety or the environment. <br />749.02 Definitions <br />As used in this chapter: <br />(a) Common Carrier by Motor Vehicle" has the same meaning as in <br />Division (E) of Section 4919.75 or Division (A) of Section 4912.02 of the <br />Revised Code, as appropriate. <br />(b) "Contract Carrier by Motor Vehicle" has the same meaning as in <br />Division (F) of Section 4919.75 or Division (A) of Section 4923.02 of the <br />Revised Code, as appropriate. <br />(c) "Costs" shall include, but not limited to, all direct and <br />incidental costs, including personnel costs, incurred by or on behalf of <br />the Village in connection with the investigation, mitigation, minimiza- <br />tion, removal or abatement of an unauthorized spill, release or dis- <br />charge, in the following respects:
