<br />ORDINANCE NO. 78--59 <br />SY• <br />AN EMERGENCY ORDINANCE APPROVING A CONTRACT <br />WITH THE CLEVELAND ELECTRIC ILLUNFLNATING <br />COMPANY FOR THE PROVISION OF STREET LIGHTING <br />WITHIN THE NNNICIPALITY. <br />WHEREAS, the Cleveland Electric Illuminating Company, <br />under the terms of an existing contract, has provided notice of <br />cancellation of said contract as of December 31, 1978, as required <br />therein; and <br />WHEREAS, a new nine-year contract has been proposed <br />by CEI on a non-negotiable basis; and <br />WHEREAS, CE2, being a monopoly, is the only entity capable <br />of providing such service to the municipality, thus rendering <br />the item noncompetitive and not subject to bidding requirements; <br />now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The contract with the Cleveland Electric <br />Illuminating Company for street lighting in the form attached <br />hereto and made a part hereof as Exhibit "A", as if fully rewritten <br />at this point, is approved. The Mayor and Finance Director are <br />authorized, empowered and directed to execute same and deliver <br />a fully executed copy to the Cleveland Electric Illuminating Company <br />prior to December 31, 1978. <br />Section 2. This is an emergency ordinance immediately <br />necessary for the preservation of the health, welfare and safety <br />of the residents of Mayfield Village, Ohio, in that it provides <br />for necessary lighting of streets, for which the current contract <br />expires in less than 30 days. It shall therefore take effect <br />immediately upon passage by the affirmative vote of not less than <br />five (5) members elected to Council and approval by the Mayor, <br />or otherwise at the earliest time allowed by law, in which case <br />it shall be retroactive in its operation to January 1, 1979. <br />President of Council <br />PASSED: <br />APPROVIIDI: <br />Robert G.
