<br />RESOLUTION NO. 78-67 <br />INTRODUCED BY: Mrs. Hanus <br />AN EMERGENCY RESOLUTION1REJECTING THE NOACA WATER <br />QUALITY MANAGEMENT PLAN. <br />WHEREAS, pursuant to Section 208 of the Clean Water Act, <br />United States Pub13c Law 92-500 and 95-217, regulations have been <br />promulgated for urban areas, including northern Ohio, which has <br />substantial water quality control problems; and <br />WHEREAS, the Northeast Ohio Areawide Coordinating <br />Agency (NOACA): has been designated by the Governor of Ohio as the <br />planning agency to be involved in this control situation; and <br />WHEREAS, without adequate prior notice to any of the <br />municipalities, NOACA has published a management plan which will <br />become effective unless rejected by the various communities; and <br />WHEREAS, within NOACA and other Federal agencies, the <br />plan has been criticized for defic3encies and lack of clarity; and <br />WHEREAS, thts Council wis&es to avoid establishment of <br />another layer of government functioning ineffectively and expen- <br />sively without being responsible to any electorate; now, therefore, <br />BE IT RESOLVED BX THE COUNCTL OF THE VILLAGE OF MAYFIELD, OHIO, THAT: <br />Section 1. The Vxilage of May£ield rejects the proposed <br />water qualsty management plan of the Northeast Ohio Areawide Coordi- <br />nating Ageney and requests that the Executive Board of NOACA also <br />withhold approval and submission for State certification until all <br />major issues are resolved, deficiencies remedied and sufficient <br />time given for individual municipal review. <br />Section 2. The Clerk is authorized, empowered and directed <br />to send a copy of this Resolution to the NOACA Policy Board, to <br />its executive committee, the members of the Board of County Commis- <br />sioners of Cuyahoga County, the Federal Environmental Protection <br />Aqency and the State of Ohio Environmental Protection Agency. <br />Section 3. Th3s Resolution is declared to be an emergency <br />measure immediately necessary for the preservation of the public <br />health and safety in that Federal regulations require immediate <br />action by this Council. This Resolution shall therefore take effect <br />immediately upon passage by the affirmative vote of not less than <br />\
