ORDINANCE NO. 79-6 <br />BY: <br />AN EMERGENCY ORDINANCE CONFIRMING THE APPOINTMENT <br />OF THE LAW DIRECTOR AND ACCEPTING THE CONTRACT <br />FOR HIS COMPENSATION AND DUTIES. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor's appointment of Guerin L. <br />Avery as Law DirT tor for Mayfield Village is hereby confirmed. <br />Section 2. Effective January 1, 1979 the contract <br />of the Law Direceviously executed on November 30, 1977 <br />is hereby extended subject to the following terms and conditions: <br />(a) Dale C. Feneli shall attend all Council caucuses, <br />regular meetings of Council and such other meetings as the Law <br />Director is required or requested to attend when unavoidable <br />conflicts make Guerin L. Avery unavailable; <br />month; <br />(b) The monthly retainer shall be $1,050.00 per <br />(c) The hourly fee for actual physical attendance <br />at Court, arbitrations or depositions, including travel time, <br />shall be $52.50 per hour, subject to a maximum of $315.00 per <br />day; <br />(d) Subject to the cancellation provisions of the <br />aforementioned contract, this contract shall be effective until <br />December 31, 1979 or until the appointment of a successor Law <br />Director, whichever is later. <br />Acceptance by the Law Director of reappointment <br />to that position shall be deemed to be acceptance by him of the <br />terms of said contract with the modifications as set forth herein- <br />above. <br />Section 3. It is specifically understood that the <br />Law Director is-' not precluded from private practice of law <br />relatinq to the defense of both criminal and traffic cases in <br />the Lyndhurst Municipal Court except in such cases in which the <br />Village of Mayfield, either under its own ordinances or on behalf <br />of the State of Ohio, is the prosecuting party. <br />Section 4. This is an emergency,ordinance immediately <br />necessary for the preservation of the health, safety and welfare <br />of the residents of Mayfield Village in that it provides for
