IORDINANCE NO. 79-56 <br />INTRODUCED BY: Mayor and Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHOR22ING PAYMENT <br />OF $890.16 TO THE CUYAHOGA COUNTY MAYORS <br />AND CITY MANAGERS ASSOCIATION AS ESCROW <br />AGENT FOR THE PURPOSES OF CONDUCTING <br />LITIGATION AGAINST THE CITY OF CLEVELAND <br />REGARDING THE WATER DEPARTMENT <br />WHEREAS, this Council previously authorized litigation on a <br />combined basis with other municipalities against the Cleveland Water <br />Department seeking regionalization or other remedies appropriate to <br />insure a continued adequate supply of potable water to Mayfield Village; and <br />WHEREAS, this litigation is ongoing; and <br />WHEREAS, the Cuyahoga County Mayors and City Managers Association, <br />as escrow agent, has reported that funds currently available are inadequate <br />and have asked for an additional contribution at the rate of 8 cents <br />per capita from each community involved; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section l. The sum of Eight Hundred Ninety Dollars and Sixteen <br />Cents ($890.16) is hereby appropriated and the Clerk is authorized, <br />empowered and directed to obtain from the Finance Director a check in <br />that amount payable to the Cuyahoga County Mayors and City Managers <br />Association as escrow agent for the water fund. <br />Section 2. This is an emergency Ordinance immediately necessary <br />for the preservation of the health, welfare and safety of the residents <br />of the community for the reasons stated in the preamble. It shall therefore <br />take effect immediately upon passage by the affirmative vote of not less <br />than five (5) members elected to Council and approval by the Mayor or <br />otherwise at the earliest time allowed by law. <br />President of Council <br />PASSED: <br />APPROVED: <br />Robert G.
