. <br />ORDINANCE NO. 79- 57 <br />INTRODUCED BY: Council as a Whole <br />AN EMERGENCY ORDINANCE DETERMINING <br />TO PROCEED WITH THE IMPROVEMENT OF <br />ECHO DRIVE BY HAVING IT REPAVED AND <br />REDITCHED. <br />WHEREAS, this Council did duly adopt Resolution No. 79-52 <br />on August 6, 1979, declaring therein the necessity of the proposed <br />improvement hereinafter described; and <br />WHEREAS, pursuant to said Resolution, estimated assessments <br />with respect to the said improvement were duly prepared and placed <br />on file in the o££ice of the Clerk of this Council; and <br />WHEREAS, no objections to said estimated assessments were <br />filed within the period provided by law; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. It is hereby determined to proceed with the <br />improvement of Echo Drive by having it repaved and reditched in <br />accordance with the provisions of Resolution No. 79-52 and in <br />accordance with the plans, specification and the estimate of cost <br />for said improvement heretofore approved and filed in the office <br />of the Clerk of this Council <br />Section 2. The estimated assessments of the cost of <br />said improvement:,heretofore prepared and filed in the office of <br />the Clerk be and the same hereby are adopted. <br />Section 3. It is further determined that the portion <br />o£ the cost of said improvement to be assessed against benefitted <br />property shall be assessed in the amount, manner and number of <br />installments as provided for in the said Resolution 79-52. <br />Section 4. The Clerk of this Council is hereby authorized <br />and directed to adve'rtise for bids for the construction of said <br />i mprovement in the manner provided by law. <br />Section 5. This Ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />public peace, health, safety and welfare of the residents of <br />May,field Village in that the improvement authorized herein•will <br />help insure safe access for emergency, service and passenger motor <br />vehicles on and through Echo Drive. It shall therefore take effect <br />itnmediately upon passage by the affirmative vote of not less than
