ORDINANCE N0. 79-59 <br />INTRODUCED BY: Council as a Whole <br />AN EMERGENCX ORDINANCE CO_*dSENTING TO COOPERATE <br />WITH CUYAHOGA COUNTY, OHIO AND THE OHTO DEPARTf4ENT <br />OF TRANSPORTATION IN THE REPLACEP4EPdT OF STANDARD <br />CURB INLET GRATES ON WILSON MILLS ROAD FROP•1 THE <br />MAYFTELD VTLLAGE EASTERN CORPORATION LINE TO SOM <br />CENTER ROAD. <br />WHEREAS, the County of Cuyahoga and the Ohio Department <br />of Transportation are considering the improvement of T4ilson Mills <br />Road (County Road - 73) by replacing the standard curb inlet grates <br />with slanted slot grates from the P4ayfield Village Eastern corpora- <br />tion line to SOM Center Road; and <br />WHEREAS, the replacement of the aforesaid qrates wi11 pro- <br />vide increased public safety while traveling on said roadway; and <br />WHEREAS, required municipal financial participation is <br />minimal and Council wishes to take advantage of this opportunity <br />to have the necessary repair work done; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF iMP,YFIELD VILLAGE, OHIO, THAT: <br />Section l. Consent is hereby given to the County of <br />Cuyahoga and to the Ohio Department o£ Transportation to improve <br />Wilson D4ills Road (County Road - 73) by the reolacement of the <br />standard curb inlet grates with slanted slot grates from the Pday- <br />field Village Eastern corporation line to SOP•1 Center Road, in <br />accordance with plans, specifications and estimates approved by <br />the County. <br />Section 2. 24ayfield Village proooses to cooperate with <br />Cuyahoga County and with the Ohio Department of Transportation by <br />approving an application by the Board of County Commissioners for <br />municipal cooperation with Cuyahoga County in the cost of the <br />improvement project to the extent of funds received by an allocation <br />from the Cuyahoga County Motor Vehicle $5.00 license tax fund. <br />Section 3. The Mayor and Finance Director are hereby <br />authorized, empowered and directed to enter into maintenance and <br />parking agreements with said project and any other special con- <br />tractual obligations necessary and incidental to its completion. <br />Section 4. The contract form shall be that attached <br />hereto and made a part hereof as Exhibit "A" or any form substantially <br />similar thereto approved by the Director of Law. <br />Section 5. This ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the
