RESOLUTION N0. 79-71 <br />INTRODUCED BY: Council as a Whole <br />A RESOLUTION DETERMINING THAT THE IMPROVEMENTS <br />TO ECHO DRIVE SHOULD BE MADE. <br />' WHEREAS, this Council did heretofore adopt Resolution No. 79-52, <br />on the 6th day of August, 1979 declaring therein the necessity of <br />improving Echo Drive, within the municipality, by having it repaved <br />and reditched; and <br />WHEREAS, the lowest and best bid for labor and materials for <br />said improvement received by Mayfield Village exceeds by fifteen <br />percent (150) or more the estimated cost of such labor and materials <br />heretofore filed in the office of the Clerk of this Council; and <br />WHEREAS, pursuant to Section 727.24 of the Ohio Revised Code, <br />a notice of public hearing on the question of whether said improvement <br />should be made was duly published as required by law; and <br />WHEREAS, all property owners to be assessed for said improvement <br />and who desire to be heard on the question of whether said improvement <br />should be made were heard by this Council at the time and place <br />provided for in said notice; and <br />WHEREAS, this Council has examined and reviewed the lowest and <br />best bid for labor and materials for said improvements; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. It is hereby determined that the improvement <br />provided for in Resolution No. 79-52 should be made. <br />Section 2. That the Mayor and Finance Director are hereby <br />authorized and directed to enter into a contract on behalf of Mayfield <br />Village with the lowest and best bidder for the construction of said <br />improvement. <br />Section 3. This Resolution is hereby declared to be an. <br />emergency measure immediately necessary for the preservation of the <br />public peace, health, safety and welfare of the residents of May£ield <br />Village in that the improvement authorized herein will help insure <br />safe access for emergency, service and passenger motor vehicles. It <br />shall therefore take effect immediately upon passage by the affirmative <br />RESOLUTION N0. 79-71
