RESOLUTION N0. 79-71 INTRODUCED BY: Council as a Whole A RESOLUTION DETERMINING THAT THE IMPROVEMENTS TO ECHO DRIVE SHOULD BE MADE. ' WHEREAS, this Council did heretofore adopt Resolution No. 79-52, on the 6th day of August, 1979 declaring therein the necessity of improving Echo Drive, within the municipality, by having it repaved and reditched; and WHEREAS, the lowest and best bid for labor and materials for said improvement received by Mayfield Village exceeds by fifteen percent (150) or more the estimated cost of such labor and materials heretofore filed in the office of the Clerk of this Council; and WHEREAS, pursuant to Section 727.24 of the Ohio Revised Code, a notice of public hearing on the question of whether said improvement should be made was duly published as required by law; and WHEREAS, all property owners to be assessed for said improvement and who desire to be heard on the question of whether said improvement should be made were heard by this Council at the time and place provided for in said notice; and WHEREAS, this Council has examined and reviewed the lowest and best bid for labor and materials for said improvements; now, therefore, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: Section 1. It is hereby determined that the improvement provided for in Resolution No. 79-52 should be made. Section 2. That the Mayor and Finance Director are hereby authorized and directed to enter into a contract on behalf of Mayfield Village with the lowest and best bidder for the construction of said improvement. Section 3. This Resolution is hereby declared to be an. emergency measure immediately necessary for the preservation of the public peace, health, safety and welfare of the residents of May£ield Village in that the improvement authorized herein will help insure safe access for emergency, service and passenger motor vehicles. It shall therefore take effect immediately upon passage by the affirmative RESOLUTION N0. 79-71
