ORDINANCE NO. 79-72 <br />INTRODUCED BY: Council as a Whole <br />AN EMERGENCY ORDINANCE DETERMINING TO <br />PROCEED WITH THE IMPROVEMENT OF ECHO <br />DRIVE BY HAVING IT REPAVED AND REDITCHED. <br />WHEREAS, this Council did duly adopt Resolution No. 79-52 <br />on Auqust 6, 1979, declaring therein the necessity of the proposed <br />improvement hereinafter described; and <br />WHEREAS, pursuant to said Resolution, estimated assessments <br />with respect to said improvement were duly prepared and placed on file <br />in the office of the Clerk of this Council; and <br />WHEREAS, one or more objections to said estimated assessments <br />having been filed, this Council did, by Resolution No. 79-63, pass on <br />August 30, 1979 duly appoint an Assessment Equalization Board to hear <br />and determine such objections and to equalize said assessments; and <br />WHEREAS, said Assessment Equalization Board has heard and <br />determined all such objections, as equalized said assessments and has <br />submitted its report and recommendations to this Council; and <br />? WHEREAS, this Council did duly adopt Resolution No. 79-64 on <br />September 17, 1979, approving said report and recommendations o£ said <br />Board; now, there£ore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. It is determined to proceed with the improvement <br />of Echo Drive by having it repaved and reditched in accordance with <br />the provisions of Resolution No. 79-52 and in accordance with the plans, <br />specifications and the estimate of cost for said improvement heretofore <br />approved and £iled in the o££ice o£ the Clerk o£ this Council. <br />Section 2. The estimated assessments of the cost of said <br />improvement heretofore prepared and filed in the office of the Clerk <br />be and the same hereby are adopted. <br />Section 3. It is further determined that the portion of the <br />cost of said improvement to be assessed against benefitted property <br />shall be assessed in the amount, manner and number of installments as <br />provided for in the said Resolution No. 79-52. <br />Section 4. The Clerk of this Council is hereby authorized and <br />directed to advertise for bids for the construction of said improvement <br />in the manner provided by law. <br />. Section 5. This Ordinance is hereby declared to be an emerqency <br />measure necessary £or the immediate preservation o£ the public peace,
