? <br />ORDINANCE N0. 79-76 <br />INTRODUCED BY: Mr. Busa <br />AN ORDINANCE APPROPRIATING FEE SIMPLE <br />INTEREST IN THE REAL PROPERTY LOCATED <br />AT 6635 WILSON MILLS ROAD, MAYFIELD <br />VILLAGE, OHIO. <br />WHEREAS, on the 15th day of January, 1979, the Council <br />of Mayfield Village, Ohio, adipted Resolution No. 79-5 declaring <br />the necessity and intention of appropriating the property de-scribed <br />in Exhibit A, and notice of the adoption of said Resolution has <br />been served on the owners, persons in possession or those having <br />an interest of record in the premises; and <br />WHEREAS, the property described in Exhibit A is needed <br />for the public purpose of expansion of the current municipal <br />complex to provide for better and additional municipal services; <br />now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OH2O, THAT: <br />Section 1. A fee simple interest in and to the parcel <br />of real estate described in Exhibit A be and the same hereby is <br />appropriated for municipal purposes, to wit: the expansion of <br />the current municipal complex so as to provide for better and <br />additional municipal services, pursuant to and in accordance with <br />the Constitution and laws of the State of Ohio. <br />Section 2. This Council finds that the appropriation of <br />property made herein is necessary for said public purpose and that <br />the Village has been unable to agree with the owners of the property <br />appropriated herein. <br />Section 3. The Director of Law is hereby authorized and <br />directed to file a Complaint for Appropriation in a court o£ <br />competent jurisdiction to have a jury impaneled to make inquiry <br />into and assess the compensation to be paid for the property <br />described in Exhibit A. <br />Section 4. This is an emergency ordinance immediately <br />necessary for the preservation of the health, safety and welfare <br />of the residents of Mayfield Village in that it provides for the <br />continued expansion and improvement of municiapal services. It <br />shall therefore take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to' <br />Council and approval by the Mayor or otherwise at the earliest <br />time allowed by law. <br />'res!W of Council <br />PASSED: 10/15/79
