Ordinance No. 74- 36 Introduced by: COUNCIL AS A 14fIOLE AN ORDINANCE DETERMINING TO PROCEED WITH THE IMPROVEMENT OF ECHO DRIVE BY THE INSTALLATION OF AN EIGHT-INCH WATER MAIN, HYDRANTS AND ALL NECESSARY APPURTENANCES THERETO; AND DECLARING AN EMERGENCY WHEREAS, this Council did duly adopt Resolution #862, on the 20th day of May, 1974, declaring therein the necessity of the proposed improvement hereinafter described; and WHEREAS, pursuant to said resolution, estimated assessments with respect to said improvement were duly prepared and placed on file in the office of the Clerk-Treasurer of the Village; and WHEREAS, two objections to said estimated assessments having tieen filed, this Council did, by Resolution No. 864, passed the 17th day of June, 1974, duly appoint an Assessment Equalization Board to herein determine such objections and to equalize said assessments; and WHEREAS, said Assessment Equalization Board heard and determined all such objections,has equalized said assessments and has submitted its report and recommendations to this Council; and WHEREAS, this Council did duly adopt Resolution No. 865 on the 15th day of July, 1974, approving said report and recommendations of said Board. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, CUYAHOGA COUNTY, OHIO, three-fourths of the members elected thereto concurring: Section 1. That it is hereby determined to proceed with the improvement of Echo Drive by the installation of an eight-inch water main, hydrants, and all necessary appurtenances thereto, in accordance with the provisions of Resolution #862, and in accordance with plans, profiles, specifications and the estimate of cost for such improvement hereto£ore approved and filed in the office of the Clerk- Treasurer of the Village. Section 2. That the estimated assessments of the cost of said improvement heretofore prepared and filed in the office of said Clerk-Treasurer and as equalized by the Assessment Equalization Board hereinabove referred to, be and the:same are hereby adopted. Section 3. That it is further determined that the portion of the cost of said improvement to be assessed against benefitted property shall be assessed in the amount, manner and number of installments as provided for in said Resolutions declaring the necessity o£ said improvement.
