ORDINANCE N0. 74-40 <br />Introduced by: Council as a Whole <br />AN ORDINANCE DETERMINING TO PROCEED WITH THE IMPROVEMENT <br />OF ECHO DRIVE BY THE INSTALLATION OF AN EIGHT-INCH WATER <br />MAIN, HYDRANTS, AND ALL NECESSARY APPURTENANCES THERETO; <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council did duly adopt Resolution No. 862 on the 20th day of <br />May, 1974, declaring therein the necessity of the proposed improvement hereinafter <br />described; and <br />WHEREAS, pursuant to said resolution, estimated assessments with respect to <br />said improvements were duly prepared and placed on file in the office of the Clerk- <br />Treasurer; and <br />WHEREAS, one or more objections to said estimated assessments having been <br />filed, this council did by Resolution No. 864, passed the 17th day of June, 1974, <br />duly appoint an Assessment Equalization Board to hear and detexmine such objections <br />and to equalize said assessments; and <br />WHEREAS, said Assessment Equalization Board has heard and determined all such <br />objections, has equalized said assessments and has submitted its report and recommenda- <br />tions to this council; and <br />WHEREAS, this council did duly adopt Resolution No. 865, on the 15th day of <br />July, 1974 approving said report and recommendations of said board; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF MAYFIELD, <br />CUYAHOGA COUNTY, OHIO, BY 3/4TH OF THE MEMBERS ELECTED THERETO CONCURRING: <br />Section 1. That it is hereby determined to proceed with the improvement of <br />Echo Drive by the installation of an eight-inch water main, hydrants, and all necessary <br />appurtenances thereto, in accordance with the provisions of Resolution No. 864, and <br />in accordance with plans, profiles, specifications and estimate of the cost of said <br />improvement heretofore approved and £iled in the office of the Clerk-Treasurer. <br />Section 2. That the estimated assessments of the cost of said improvement <br />heretofore prepared and filed in the office of said Clerk-Treasurer and as equalized <br />by the Assessment Equalization Board hereinabove referred to, be and the same are <br />hereby adopted. <br />Section 3. That it is further determined that the portion of the cost of <br />said improvement to be assessed against benefitted property owners shall be assessed <br />in the amount, manner, and number of installments as provided in said resolution declar- <br />ing the necessity for said improvement.
