ORDINANCE N0. 74-52 <br />Introduced by: Council as a Whole <br />AN ORDINANCE AUTHORIZING THE PURCHASE OF CERTAIN REAli <br />PROPERTY FROM STATE SAVINGS DEVELOPMENT CORPORATION <br />Section 1. The Mayor and Clerk Treasurer be and they are hereby authorized <br />and directed to purchase the real estate more fully described in Exhibit "A" <br />attached hereto and incorporated herein. <br />Section 2. The consideration to be paid for said property is $75,000 and <br />the same is to be paid upon execution and delivery to the Village of Mayfield of <br />a good and sufficient warranty deed accompanied by title guaranty covering said <br />premises to the Village of Mayfield in fee simple, free and clear of all liens and <br />encumbrances, except conditions and restrictions of record, zoning ordinances and <br />taxes and assessments levied and assessed subsequent to the date of conveyance. <br />Said warranty deed and title guaranty are to be to the satisfaction of the Solicitor. <br />Section 3. The amount to be paid for said property, together with any cost <br />or expense incurred by the Village of Mayfield in connection with the acquisition <br />thereof, shall be paid in the following manner: <br />a. $40,000 from the building equipment and maintenance fund. <br />b. The balance from the general fund. <br />Section 4. Council declares this to be an emergency ordinance necessary for <br />the preservation of the public peace, health and safety, such emergency arising out <br />of the necessity to acquire said real property for municipal expansion without <br />undue delay, in order to maintain proper services for residences of this municipality; <br />wherefore, this ordinance shall take effect and be in force from and after its <br />passage. <br />Passed this 18th day of NovembE <br />Attest: <br />? ) CLERK-TREASURER <br />
