Ordinance No. 76_22 introduced by:Council as a Whole AN ORDINANCE DETERMINING TO PROCEED WITH THE IMPROVEMENT OF BEECH HILL ROAD NORTHERLY FROPI ITS INTERSECTION WITH SENECA DRIVE A DISTANCE OF APPROXIMATELY 685 EEET BY THE PAVING THEREOF, AND DECLARING AN EMERGENCY WHEREAS, this Council did adopt Resolution l1936 on the 21st day of June, 1976 declaring therein the necessity of the proposed improvement hereafter described; and WHEREAS, pursuant to said Resolution estimated assessments with respect to said improvement were duly prepared and placed on £ile in the office of the Clerk of this Council; and WHEREAS, one or more objections to said estimated assessments having been filed, this Council did, by Resolution 11947, passed on July 19, 1976, duly appoint an Assessment EqualizationBoard to hear and determine such objections; and WHEREAS, said Assessment Equalization Board has heard and detexmined all such objections, has equalized said assessments, and has submitted its report and con- ditions to this Council; and WHEREAS, this Council did duly adopt Resolution li 1956 , on Sept. _ 2, 1976 approving said report and recommendations of said Board; now, therefore, BE IT ORDAINED BY THECOUNCIL, THREE-FOURTHS OF THE MEMBERS ELECTED THERETO CONCURRING, THAT: Section 1. It is hereby determined to proceed with the improvement o£ Beech Hill Road northerly from its intersection with Seneca Drive, a distance of approximately 685 feet by the paving thereof, in accordance with plans, pro£iles, spec- £ications and the estimate oP the cost of said improvement heretofore approved and filed in the office of the Clerk of this Council. Section 2. The estimated assessments of the cost of said improvement hereto- £ore prepared and filed in the office of said Clerk and as equalized by the Assessment Equalization Board hereinabove referred to be and the same are hereby adopted. Section 3. It is further determined that the portion of the cost of said improvement to be assessed against benefitted property owners shall be assessed in the amount, manner and number of installments as provided for in said Resolution declaring the necessity of said improvement. Section 4. All claims for damages resulting from said improvement that have been filed in accordance with law shall be inquired into after the completion of said improvement. Section 5. The Mayor and Finance Director of Mayfield Village are hereby authorized and directed to advertise for bids for the construction o£ said improvement in the manner provided by law and subject to the provisions of R.C. 727.24 and the availability oP funds to enter into a contract for said improvement with the lowest and best bidder.
