Ordinance No. 76_22 <br />introduced by:Council as a Whole <br />AN ORDINANCE DETERMINING TO PROCEED WITH THE <br />IMPROVEMENT OF BEECH HILL ROAD NORTHERLY FROPI <br />ITS INTERSECTION WITH SENECA DRIVE A DISTANCE <br />OF APPROXIMATELY 685 EEET BY THE PAVING THEREOF, <br />AND DECLARING AN EMERGENCY <br />WHEREAS, this Council did adopt Resolution l1936 on the 21st day of June, 1976 <br />declaring therein the necessity of the proposed improvement hereafter described; and <br />WHEREAS, pursuant to said Resolution estimated assessments with respect to <br />said improvement were duly prepared and placed on £ile in the office of the Clerk <br />of this Council; and <br />WHEREAS, one or more objections to said estimated assessments having been <br />filed, this Council did, by Resolution 11947, passed on July 19, 1976, duly appoint an <br />Assessment EqualizationBoard to hear and determine such objections; and <br />WHEREAS, said Assessment Equalization Board has heard and detexmined all such <br />objections, has equalized said assessments, and has submitted its report and con- <br />ditions to this Council; and <br />WHEREAS, this Council did duly adopt Resolution li 1956 , on Sept. _ 2, 1976 <br />approving said report and recommendations of said Board; now, therefore, <br />BE IT ORDAINED BY THECOUNCIL, THREE-FOURTHS OF THE MEMBERS ELECTED THERETO <br />CONCURRING, THAT: <br />Section 1. It is hereby determined to proceed with the improvement o£ <br />Beech Hill Road northerly from its intersection with Seneca Drive, a distance of <br />approximately 685 feet by the paving thereof, in accordance with plans, pro£iles, spec- <br />£ications and the estimate oP the cost of said improvement heretofore approved and filed <br />in the office of the Clerk of this Council. <br />Section 2. The estimated assessments of the cost of said improvement hereto- <br />£ore prepared and filed in the office of said Clerk and as equalized by the Assessment <br />Equalization Board hereinabove referred to be and the same are hereby adopted. <br />Section 3. It is further determined that the portion of the cost of said <br />improvement to be assessed against benefitted property owners shall be assessed in the <br />amount, manner and number of installments as provided for in said Resolution declaring <br />the necessity of said improvement. <br />Section 4. All claims for damages resulting from said improvement that have <br />been filed in accordance with law shall be inquired into after the completion of said <br />improvement. <br />Section 5. The Mayor and Finance Director of Mayfield Village are hereby <br />authorized and directed to advertise for bids for the construction o£ said improvement <br />in the manner provided by law and subject to the provisions of R.C. 727.24 and the <br />availability oP funds to enter into a contract for said improvement with the lowest <br />and best bidder. <br />
