<br />ORDINANCE N0. 71-40 <br />BY: MR: FITZ-GERALD <br />AN EPIERGENCY ORDINANCE AWARDING A CONTRACT <br />FOR ELECTRIC STREET LIGHTING SERVICE IN <br />THE MUNICIPALITY TO THE CLEVELAND ELECTRIC <br />ILLUMINATING COMPANY <br />WHEREAS, pursuant to Resolution No. 802 of the Council of the <br />Municipality passed August 16, 1971, authorizing and directing the Clerk <br />to advertise for bids for furnishing electric street lighting service in <br />the Pfunicipality, The Cleveland Electric Illuuminating Company submitted <br />a proposal dated September 14, 1971; and <br />WHEREAS, said proposal is in the proper form and is the lowest <br />and best bid. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF PiAYFIELD, CUYAHOGA <br />COUNTY, OHIO: <br />Section 1. That said proposal of The Cleveland Electric Illuminating <br />Company for furnishing electric street lighting service in the Municipality be <br />and the same is hereby accepted, and that the proper officers of the Municipality <br />be and they are hereby authorized and directed to execute a contract in the name <br />of the Pfunicipality with The Cleveland Illuminating Company for a period of <br />4 years 8 months from and after 12 noon of January 1, 1972, and from month <br />to month thereafter for an additional tcaelve months, sub3ect to cancellation <br />upon written notice by the Contractor to be given prior to April 1st in any <br />year, to be effective January 1st, in the following year, at the prices and <br />charges and in accordance with the terms and conditions specified in said <br />proposal, for installations described in Section 7(a) of the Specifications on <br />file in the office of the Clerk of the Village of Mayfield. <br />Section 2. That this ordinance is hereby declared to be an <br />emergency measure in that it is necessary for the immediate preservation of <br />the public peace, health and safety of the Municipality for the reason that such <br />electric street lighting is essential for the protection of pedestrian and <br />vehicular traffic within this Municipality, and provided it receives the <br />affirmative vote of tcoo-thirds of all of the members elected to Council, it <br />shall take effect and be in force from and after its passage; otherwise, it <br />shall take effect and be in force from and after the earliest period allowed <br />by law. <br />Passed this 20th day of September, 1971. <br />ATTEST: <br />(Seal) Clerlc-Treasurer <br />. i._ <br />ayor- esident of Council <br /> <br />
