SCHMIDT <br />AN ORDINANCE NL4KING OhTNERS OF REAL PROPERTY (EXCEPT <br />SINGLE RESIDENCE DWELLING HOUSES) RESPONSIBLE FOR TILE <br />MAINTENANCE AND UPKEEP OF PARKING AREAS AND IMPOSING <br />A PENALTY FOR VIOLATION HEREOF. <br />BE IT ORDAIATED BY THE COUNCIL OF T_HE VILLAGE OF HAYFIELD, CUYAHOGA <br />COUNTY, OHIO; THAT: <br />Section 1. Owners of real property (other than single residence <br />dwelling houses) in the Village of Mayfield, shall be responsible for the <br />maintenance and upkeep of all parking areas used in connection with such <br />property. <br />Section 2: The owner of Such_property shall keep the exterior <br />areas, including the parking areas, free from any rubbish, garbage, waste <br />paper, junk, or any other object, material or conditions which might create <br />a health, accident or fire hazard, or adversely affect the value of the <br />property of the tenants and surrounding property, and sha1T-keep the surface <br />of the parking area and driveway in good repair, free from nuisance, and <br />in such condition that will not cause damage to vehicles or persons, or <br />impede vehicular or pedestrian traffic, and shall keep the same cleared of <br />snow. <br />Section 3. The building inspector shall examine or cause to be <br />examined any property reported to or observed by him as in violation of <br />this Ordinance, and, if a violation is found, he shall notify the owner of <br />said premises, stating the nature of the violations and requiring the owner <br />to correct the same within a period of 72 hours after the date of the notice, <br />except that a longer reasonable time may be given by the building inspector, <br />based upon the nature of the repair required, weather conditions, and other <br />relevant factors. Such notice shall be in writing and shall be served upon <br />the ocmer, either personally, or by leaving it at his last known place of <br />residence or business, or by sending it by certified mail, return receipt <br />requested, to his 'last known place of residence or business, or if such <br />place is unknown, then a copy may be sent, by certified mail, to the tax <br />mailing address of the owner as shown by the records of the Auditor of <br />Cuyahoga County. <br />Section'4. Whoever violates any provisions of this chapter or <br />any order or notice made hereunder, shall be guilty of a misdemeanor, and, <br />upon conviction thereof, shall be fined not to exceed $50.00 per day, or <br />shall be committed not more than three days in jail, or both, and each day <br />of violation shall constitute a separate offense. <br />
