r5' ORDINANCE N0. 65--25 BY: MR. SCHMIDT AN ORDINANCE TO REGULATE THE USE, STORAGE AND TRANSPORTATION OF EXPLOSIVES FOR BLASTING PURPOSES AND PYROTECHNIC DISPLAYS AND REPEALING ORDINANCES NOS. 541, 831 and 904. BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA COUNTY, OHIO, THAT: Section 1. It shall be unlawful for any person, firm or corporation to blast with dynamite, gun powder or any other explosive compound, within the limits of the Village of Mayfield, Ohio, unless there first shall have been obtained a written permit from the Chief of Police. Said permit shall set forth the time at which and the circumstances under which said blasting may be done. The fee for such permit shall be Ten Dollars ($10.00), and said permit shall be for such period as the Chief of Police may designate, but not for over sixty (60) days; the permit may be renewed by the Chief of Police for an additional period of sixty (60) days without payment of additional fee. Section 2. Before a permit to do blasting shall be issued, the ap- plicant for such permit shall file a liability insurance policy in the sum of One Hundred Thousand Dollars ($100,000.00) for any one individual, and Three Hundred Thousand Dollars ($300,000.00) for any accident, covering bodily injury, and wrongful death, and in the amount of Fifty Thousand Dollars ($50,000.00) covering property damage of any nature caused by such blasting. Such policy must be approved by the Solicitor of the Village, and the policy or copy thereof shall be filed with the Chief of Police. Said policy shall name the Village of Mayfield as an additional insured. Section 3. The Village Engineer shall supply an Inspector who shall supervise all drilling, charging and shooting of all holes; who shall not be required by the contractor to work less than six (6) hours in any one day. Section 4. Blasting operations shall not be conducted between the hours of 7:00 o'clock p.m, and 7:00 o'clock a.m., nor at any time on Sundays, except by special permission of the Chief of Police. Section 5. At least twenty-four (24) hours in advance of blasting, the blaster shall give written notice specifying the location and intended time of blasting to the appropriate representatives of the gas, electric, water, fire alarm, telephone, telegraph and steam utilities which operate within the municipality. In an emergency, the Chief of Police may waive the time limit and allow verbal instead of written notice to be given Section 6. Electric blaAing caps only shall be used as the detonating agent for blasting operations in congested districts, or on highways or adjacent to highways open to traffic
