r5' <br />ORDINANCE N0. 65--25 <br />BY: MR. SCHMIDT <br />AN ORDINANCE TO REGULATE THE USE, STORAGE AND TRANSPORTATION <br />OF EXPLOSIVES FOR BLASTING PURPOSES AND PYROTECHNIC DISPLAYS <br />AND REPEALING ORDINANCES NOS. 541, 831 and 904. <br />BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF HAYFIELD, CUYAHOGA <br />COUNTY, OHIO, THAT: <br />Section 1. It shall be unlawful for any person, firm or corporation <br />to blast with dynamite, gun powder or any other explosive compound, within the <br />limits of the Village of Mayfield, Ohio, unless there first shall have been <br />obtained a written permit from the Chief of Police. Said permit shall set forth <br />the time at which and the circumstances under which said blasting may be done. <br />The fee for such permit shall be Ten Dollars ($10.00), and said permit shall <br />be for such period as the Chief of Police may designate, but not for over sixty <br />(60) days; the permit may be renewed by the Chief of Police for an additional <br />period of sixty (60) days without payment of additional fee. <br />Section 2. Before a permit to do blasting shall be issued, the ap- <br />plicant for such permit shall file a liability insurance policy in the sum of <br />One Hundred Thousand Dollars ($100,000.00) for any one individual, and Three <br />Hundred Thousand Dollars ($300,000.00) for any accident, covering bodily injury, <br />and wrongful death, and in the amount of Fifty Thousand Dollars ($50,000.00) <br />covering property damage of any nature caused by such blasting. Such policy <br />must be approved by the Solicitor of the Village, and the policy or copy thereof <br />shall be filed with the Chief of Police. Said policy shall name the Village of <br />Mayfield as an additional insured. <br />Section 3. The Village Engineer shall supply an Inspector who shall <br />supervise all drilling, charging and shooting of all holes; who shall not be <br />required by the contractor to work less than six (6) hours in any one day. <br />Section 4. Blasting operations shall not be conducted between the <br />hours of 7:00 o'clock p.m, and 7:00 o'clock a.m., nor at any time on Sundays, <br />except by special permission of the Chief of Police. <br />Section 5. At least twenty-four (24) hours in advance of blasting, <br />the blaster shall give written notice specifying the location and intended time <br />of blasting to the appropriate representatives of the gas, electric, water, <br />fire alarm, telephone, telegraph and steam utilities which operate within the <br />municipality. In an emergency, the Chief of Police may waive the time limit <br />and allow verbal instead of written notice to be given <br />Section 6. Electric blaAing caps only shall be used as the detonating <br />agent for blasting operations in congested districts, or on highways or adjacent <br />to highways open to traffic <br /> <br />
