ORDINANCE N0. 70-26 <br />BY : MR. S CHPtI DT <br />~ AN ORDINANCE AUTHORIZING THE DISBURSEMEN <br />OF FUNDS TO CONTRIBUTE TO THE COST OF <br />' LEGAL AND ENGINEERING SERVICES TO OPPOSE <br />THE SEWAGE TREATPIENT RATE INCREASES <br />WHEREAS, the City of Cleveland has promulgated and put into effect a <br />sewage treatment rate increase upon the users of water in the Village of Mayfield <br />who purchase water from said City, without reference to the contract heretofore <br />had with said City, and the facts supporting said increase are inconclusive,and <br />WHEREAS, the City of Cleveland has refused to negotiate the increase <br />with the Village of Mayfield and Council does not believe that the water users <br />in this Village are being assessed a fair and proportionate share of the increase. <br />NOW, THEREFORE, Be It Ordained by the Council of the Village of Mayfield, <br />Cuyahoga County, Ohio, that: <br />Section 1. The Village of Mayfield hereby determines to join with other <br />affected municipalities, through appropriate committees, in retaining competent <br />consulting engineers to make the necessary studies concerning fair sewage treatment <br />rates and to retain legal counsel to conduct any litigation that may be necessary <br />to establish a fair rate. Council agrees that the Village of Mayfield will pay <br />Four Cents ($.04) per thousand cubic feet of water consumed by users of water <br />within the Village of Mayfield as this Village's share of the cost of procuring <br />said engineering services and legal counsel. <br />i <br />Section 2. The Clerk-Treasurer is hereby authorized and directed to <br />mail certified copies of this Ordinance to the Cuyahoga County Piayor's and City <br />Manager's Association. <br />Section 3. This Ordinance is hereby declared to be an emergency measure, <br />necessary for the immediate preservation of the public peace, health, safety and <br />welfare of the Village of Mayfield because of the necessity of determining a fair <br />sewage treatment rate fcr its inhabitants as soon as possible, and this Ordinance <br />shall be in force and effect from and after the date of its passage. <br />Passed this 15th day of .Tune, <br />ATTEST: <br />~~ <br />(SEAL) CLERK-TREASURER <br />1970. -' <br />M>e 7[QR-PRESIDENT OF COUNCIL <br />
