ORDINANCE N0. 70-27 <br />BY: MR. SCHMIDT <br />AN ORDINANCE AUTHORIZING THE DISBURSEMENT <br />OF FUNDS TO CONTRIBUTE TO THE COST OF LEGAL <br />AND ENGINEERING SERVICES TO OPPOSE THE <br />[dATER RATE INCREASES. <br />WHEREAS, the City of Cleveland has promulgated and put into effect a <br />water rate increase upon the users of water in the Village of Mayfield who <br />purchase the same from the City of Cleveland, without reference to the contract <br />heretofore had ~vith said City, and the facts supporting such increase are <br />inconclusive, and <br />WHEREAS, the City has refused to negotiate the increase with the Village <br />of Mayfield and Council does not believe that the amount of increase imposed upon <br />the citizens of this Village is fair. <br />NOW, THEREFORE, Be It Ordained by the Council of the Village of Mayfield, <br />Cuyahoga County, Ohio, that: <br />Section 1. The Village of Mayfield determines to join with other affected <br />municipalities in retaining competent engineering consultants to make the necessary <br />studies concerning a fair water rate and in retaining legal counsel to conduct any <br />litigation that may be necessary to establish such a fair rate. Council agrees that <br />the Village of Mayfield will pay a fair share of the cost of retaining such <br />' engineering consultants and legal counsel, based upon its proportionate share of <br />~ cubic feet of water used by its residents. <br />Section 2. The Clerk-Treasurer is hereby authorized and directed to send <br />' certified copies of this Ordinance to the Cuyahoga County Mayor's and City Managers <br />Association. <br />Section 3. This Ordinance is hereby declared to be an emergency measure, <br />necessary for the immediate preservation of the public peace, health, safety and <br />welfare of the Village of Mayfield, in order that a fair rate for the use of water <br />by its residents may be established at the earliest possible time, and this Ordinance <br />shall be in force and effect from and after the date of its passage. <br />Passed this 15th day of June, 1970. <br />MAYO -PRESI OF COUNCIL <br />AT <br />~~ <br />(SEAL) CLERK-T ASURER <br />
