2 ?g <br />ORDINANCE No. 867 <br />By Mr. Belzer <br />pN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR <br />THE IMPROVED,1fiNT OF I.ANDER.ROAD IN THE ViISAGE <br />OF MAYFIELD BETWEEN,CERTAIN TERMINI.BY THE <br />CONSTRUCTION_ OF A 3ANITALiY SEGTER. WITH CORB <br />CONNECTIONS AND APPURTENANCES <br />BE IT ORDAINED BY THE COUNCIT, OF THE VILI.AGE OF MAYFIELD, CUYAHOGA COUNTY <br />STATE OF,OHIO, THAT: <br />Sec. 1. That the revised assessment of the cost and expense of the <br />I improvement of Lander Road in the Village of Mayfield, Ohio, from the existing <br />I sewer in Wilson_Mills Road Southerly to the Southerly corporation line of the <br />I Villages of Mayfield and Highland Heights by the construction oE a sanitary <br />sewer, with curb connections therefor and the necessary appurtenances <br />I amounting in the aggregate to $ 29,912.31 , as reported to this Couttcil on - <br />the 16th day of November, 1964, by the Engineer of this Village, and now on <br />file in the office of the Clerk of this Council be, and the same is, hereby <br />, adopted and confirmed, and that there be and hereby are levied and assessed <br />? upon the lots and lands bounding and abutting upon said improvement the <br />I several amounts reported as aforesaid, which assessments are in proportion <br />, to the special benefits and are not in excess of any statutory limitatiott. <br />Sec. 2. That this council hereby finds and determines that the revised <br />assessments as now on file in the office of said clerk are in the same pro- <br />portion to the estimated assessments as originally filed as the actual cost <br />of the above described improvement is to the estimated cost of the improvement <br />as originally filed. <br />Sec. 3. That the assessment against each lot or parcel of land shall <br />be payable in cash within 30 days after the passage of this ordinance or at <br />the option of the owner in twenty annual installments with interest at the <br />same rate as shall be borne by the bonds to be issued in anticipation of the <br />collection of the same. All cash payments shall be made to the Treasurer <br />of this 4illage. All assessments and installments thereof remaining unpaid <br />at the expiration of said 30 days shall be certified by the Clerk of this <br />Couttcil to the County Auditor as provided by law to be placed by him on the <br />tax duplicate and collected as other taxes are collected. <br />I Sec. 4. That the Clerk of this Council shall cause a notice of passage <br />of this ordinance to be published once in a newspaper of getteral circulation <br />.._ I in this Village and to continue on file in his office said revised assessmeats.
