Ordinance No. 935 <br />By Mr. Shaw <br />,AN ORDINANCE TO AMEND SECTION 111 OF ORDINANCE N0. 309, <br />THE TRAFFIC ORDINANCE, RELATING TO FINES, PENALTIES <br />ANDWAIVE$S <br />BE IT ORDAINED BY THE COUNCIL OF THE VI7S,AGE OE MAYFIEI.D, CUYAHOGA COUNTY, <br />OHIO, TNAT:..- <br />Sec. 1. Section 111 of Ordinance No. 309 entitled: "An Ordinance to <br />Regulate Traffic on the Streets and Public Highways of the Village of hfayfield, <br />and ILgpealing Ordinances Nos. 5, 55,, 90 and,307" is hereby amended to read <br />as follows: . <br />"Sec. 111. Fittes, Penalties and Waivers. <br />"(a) It is a misdemeanor for any person to violate any of <br />the proyisions of this ordinance unless such violation is by this <br />ordinance or other law of this state declared to be a felony. <br />"Cb) Every person convicted or found guilty of a misdemeanor <br />for a yiolation of any of the provisions of this ordinance for which <br />another penalty is not provided shall be fined not more than $500.00 <br />or imprisoned in the Couttty Jail, Municipal Jail, or Workhouse for <br />ttot more than six months, or,both. . . <br />"Notwithstanding the provisions already set forth in this <br />Section, any person who has violated any of the provisions set forth <br />in Section 5, Sectio¢s 53 to 59, Sections 76 to 90, both inclusive, <br />or Section 103-a, and who has received notice to appear in answer <br />to such violation ( other than an arrest warrant) upon filing <br />personally with the Mayor a written plea of guilty ( commottly known <br />as a waiver) within forty-eight (48) hours after such notification, <br />Sundays and_Holidays excepted, or withitt such additional period of <br />time as may be found necessary by the Piayor, may, for such offense, <br />pay a fine of One ($1.00) Dollar. Upon failure to appear itt response <br />to such notice within such_time, a warrant may be issued for the <br />arrest of the offender." <br />Sec. 2. Ecisting Section 111 of said Ordinance No. 309 is hereby <br />repealed as of the effective date of this ordinance.
