Ordinance No. 963 <br />By Mr. Davis <br />AN ORDINANCE AUTHORI2ING THE CONSTRUCTION OF A WATER <br />MAIN IN WiLSON MII.LS ROAD ON PEOPERTY.OWNfiD_BY ARTNUR <br />D,,GFARGE,_GENEVA_L. GEOAGE?AND MARY PABZI!¢.E. <br />BE IT OBDATPIED BY THE COUNCII. OF THE VILI,AGE OF MAYFIELD, CUYAHOGA COUNTY <br />OHIO, 'PHAT:_ <br />Sec.'l. Council hereby authorizes Arthur D. George, Geneva L. George <br />and Mary Parziale, to have constructed a 12" water main in Wilson Mills <br />Road, starting at the Easterly end of the existing water main and extending <br />to the Gasterly line of the property owned by said persons at 7105 Wilson <br />Mills Road. Said water main is to be constructed by a contractor to be <br />approved by the Village fingineer and shall be constructed according to the <br />rules and regulations of the Water Department of the City of Cleveland, <br />Ohio, in accordance with the plan hitherto approved by said Water Department <br />and by the Village Engineer, and subject to the approval of an Inspector <br />for the Village of Mayfield. In connection with the contract £or construction <br />of said water main there shall,be deposited with the Clerk-Treasurer of the <br />Village of Mayfield a policy ( or copy or certificate thereof) of liability <br />insurance, insuring against bodily injury liability in the amount of <br />$100,000.00 for each person and for each accident, and property damage <br />liability in the amount of $5,000.00 in connection with the work to be done <br />under said construction contract. Said contract shall also be accompanied by <br />a cash performance bond or a surety performance bond in form to be approved <br />by the Village Solicitor in the amount of the contract price, guarattteeing <br />performance of said contract and payment of all claims for labor and materials <br />furnished in connection therewith. In the event the contractor does not <br />complete performance of the contract, the owners o£ said property shall complete <br />the same, and if they fail to complete the per£oxmance of the cotttract, the <br />Village of Mayfield shall have the right to complete construction and look to <br />the property owners, the contractor, and the company executing the surety bond <br />for reimbursement thereEor. <br />Sec. 2. The owners of said property shall pay all engineering costs in <br />connection with,the installation of said water maitt. <br />Sece 3. This ordinance is hereby deemed to be an emergency measure, <br />necessary for the immediate preservation of the public health, peace, 'safietg <br />and welfare of the Village of Mayfield and its inhabitants because of the <br />necessity of supplying water as soon as possible to the owners of the property <br />abutting said improvement, and said ordinance shall be in force and effect Erom <br />and after the date of its passage. <br />Passed this 18th day of July, 1966. <br />Attest• - ' 0-=" - ?L 11- <br />Mayor - President of Cou ci <br />Seal _ Clerk-Tre surer
