It is hereby deteLmined to proceed with the i.mprovement in the <br />Village of Mayfield, Ohio, of the'Easterly side of SOM Center Boad, from a <br />point 197 £eet Northyof the intersection of the center lines of SOM Center <br />Road and Wilsott Mills Road to the Southerly line of Sandalwood Road by the <br />construction and installation of a sidewalk. <br />Sec, 2. Said i.mprovement shall be made in accordance with the provisions <br />of Resolution No. 690 adopted October 17, 19669 and with the plans, specifications, <br />esti.mates and profiles heretofore approved and now on file in the office of the <br />Clerk-Treasurer of this Council by the construction and ittstallation of a <br />sidewalk. <br />Sec. 3. p,ll claims for damages resultittg therefrom that have been <br />legally filed shall be enquired-iato be£ore the commencemettt of the proposed <br />improvement and the Solicitor is hereby authorized and directed to inatitute <br />legal proceedings in_a court of competent jurisdiction to enquire into any <br />claims that have been so filed. <br />Sec. 4. That portion of the cost provided in the above mentiotted <br />resolution of necessity to be assessed shall be assessed in the manner provided <br />in said resolution on the lots and lands described therein in tea annual installments. <br />Sec. 5. The-estimated assessments heretofore prepared and filed in the <br />office of the Clerk-Treasurer of this Council are hereby adopted. <br />Sec. 6. The Clerk-Treasurer of this Couttcil is hereby directed to deliver <br />a certiEied copy,of this Ordinance to the County Auditor within 15 days after <br />the date of its passage. <br />Sec. 7. Subject to-the provisions of Section 727.24 of the Ohio Revised <br />Code, the Mayor and Clerk-Treasurer are hereby authorized and directed as soott <br />as the funds therefor are available to pay the coat of said improvement after <br />awarding a contract to the locaest and best bidder after advertising according <br />to law and the improvement shall be financed as provided in the resolution o£ <br />necessity hereinabove referred to.
