or, <br />RESOLUTION NO. 2012-06 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY RESOLUTION <br />CONFIRMING THE PLANNING AND ZONING COMMISSION'S <br />APPROVAL OF THE CUYAHOGA COUNTY PUBLIC LIBRARY <br />SITE PLAN AND SPECIAL USE PERMIT <br />FOR THE NEW LIBRARY FACILITY <br />TO BE LOCATED AT 500 SOM CENTER ROAD <br />WHEREAS, the Cuyahoga County Public Library submitted a site plan to the <br />Planning and Zoning Commission for the approval of the installation of a new library <br />comprising 30,000 square feet and as more fully depicted on the rendering attached hereto and <br />incorporated herein by reference as Exhibit "A"; and <br />WHEREAS, the Planning Commission also reviewed the Cuyahoga County Public <br />Library's request for a special use permit; and <br />WHEREAS, the Commission approved said final site plan and special use permit at its <br />meeting of February 6, 2012 subject to certain conditions set forth therein. <br />NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. This Council hereby confirms the approval of the Village's Planning <br />and Zoning Commission of the site plan and special use permit submitted and requested by <br />the Cuyahoga County Public Library for the construction of a new library facility to be <br />located at 500 SOM Center Road. This confirmation, however, shall be contingent upon <br />Council's approval of the Revised Purchase Agreement with the Library. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Resolution have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in rrieetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the health, safety and welfare of the residents of <br />Mayfield Village. It shall, therefore, take effect immediately upon passage by the affirmative
