J <br />ORDINANCE NO. 2002-11 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHORIZING AND <br />GRANTING TO THE CUYAHOGA COUNTY BOARD OF <br />COMMISSIONERS AND THE CITY OF CLEVELAND A WATER <br />LINE EASEMENT FROM THE VILLAGE OF MAYFIELD <br />WHEREAS, the Village of Mayfield has been proceeding with the widening of S.O.M. <br />Center Road, between Wilson Mills Road north to White Road; and <br />WHEREAS, in conjunction with this project a certain water line must be relocated <br />requiring the granting of an easement by the Village of Mayfield over land which the water <br />line will be constructed; and <br />WHEREAS, the Village of Mayfield desires to authorize and grant such easement <br />to the Cuyahoga County Board of Commissioners and the City of Cleveland. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Village of Mayfield hereby grants to the Cuyahoga County Board <br />of Commissioners and the City of Cleveland a water line easement for its construction, <br />inspection, maintenance and repair as more fully described in Exhibit "A" attached hereto <br />and incorporated herein by reference. ' <br />SECTION 2. Further, the Mayor is authorized and directed to execute the <br />acceptance of this water line easement and thereafter, take the necessary steps for the <br />recordation thereof. <br />SECTION 3. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 4. This Ordinance is hereby declared to be an emergency measure <br />immediately necessaryfor the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />¢ <br />.? <br />1NT LIAM BUCKHOLTZ ' <br />Council President
