? <br />ORDINANCE NO. 2002- 30 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE APPROVING THE PLAN OF <br />OPERATION AND GOVERNANCE FOR THE NOPEC GAS AGGREGATION <br />PROGRAM FOR THE PURPOSE OF JOINTLY ESTABLISHING <br />AND IMPLEMENTING A GAS AGGREGATION PROGRAM <br />WHEREAS, this Council previously enacted legislation authorizing the Village of <br />Mayfield to establish a Gas Aggregation Program pursuant to Section 4929.26, Ohio <br />Revised Code (the "Gas Aggregation Program"), for the eligible residents, businesses and <br />other gas consumers in the Village, and for that purpose, to act jointly with any other <br />municipal corporation, city, county or other political subdivision of the State of Ohio as <br />permitted by law; and <br />WHEREAS, this Council previously enacted legislation authorizing the Village to join <br />the Northeast Ohio Public Energy Council so that the Village will be able to act jointly with <br />other member political subdivisions and thereby maximize the potential benefits of gas <br />deregulation through group purchasing efforts; and <br />WHEREAS, on behalf of this Council pursuant to Section 4929.26, Ohio Revised <br />Code, finro (2) public hearings have been held on the Plan of Operation and Governance <br />for the NOPEC Gas Aggregation Program. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. This Council finds and determines that it is in the best interest of the <br />Village, including the gas consumers located within the Village to adopt the Plan of <br />Operation and Governance of the NOPEC Gas Aggregation Program, for the purpose of <br />establishing and implementing the Gas Aggregation Program in the Village. <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law.
