L"/ <br />r: <br />ORDINANCE NO. 2002-?-35 ;? <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE AUTHORIZING THE MAYOR TO NEGOTIATE <br />AND ENTER INTO AN AGREEMENT WITH THE EAST OHIO GAS <br />COMPANY d/b/a DOMINION EAST OHIO AS AND FOR THE <br />RELOCATION OF THE GAS MAIN LINE AND RELATED FACILITIES <br />IN ORDER TO FACILITATE THE S.O.M. CENTER ROAD WIDENING PROJECT <br />WHEREAS, the Village of Mayfield has been proceeding with the widening of S.O.M. <br />Center Road, and , <br />WHEREAS, in conjunction with this project a certain gas main line and related <br />facilities must be relocated; and <br />WHEREAS, in order to facilitate this relocation the Village wishes to enter into an <br />Agreement with the East Ohio Gas Company, d/b/a Dominion East Ohio in an amount not <br />to exceed THREE HUNDRED AND NINETY THOUSAND DOLLARS ($390,000.00) of <br />which all funds shall be reimbursed by the Ohio Department of Transportation. ("ODOT") <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor is authorized and directed to negotiate and enter into an <br />Agreement with the East Ohio Gas Company d/b/a Dominion East Ohio in a form <br />substantially similar to that attached hereto and incorporated herein at Exhibit A as and for <br />the relocation of the gas main line and related facilities located along S.O.M. Center. Road <br />in coordination with the S.O.M. Center Road Widening Project in an amount not to bexceed <br />THREE HUNDRED NINETY THOUSAND DOLLARS ($390,000.00). <br />SECTION 2. The Council finds and determines that all formal actions of this Council <br />relating to the adoption of this Ordinance have been taken at open meetings of this Council; <br />and that deliberations of this Council and of its committees, resulting in such formal action, <br />took place in meetings open to the public, in compliance with all statutory requirements <br />including the requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law.
