~~- , . <br />ORDINANCE NO. 2004-43 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING THE MAYOR TO ENTER INTO <br />A MODIFICATION TO THE AGREEMENT WITH IAKE COUNTY AS AND <br />FOR STAND-BY AND EMERGENCY WATER SERVICE <br />WHEREAS, Progressive Insurance Company was desirous of a stand-by water <br />system and back-up to the Cleveland water supply in the Village of Mayfield; and <br />WHEREAS, Progressive entered into a contract to pay for the installation of any <br />equipment necessary and for the fees to provide for such stand-by service; and <br />WHEREAS, a separate Agreement was entered into between Lake County and <br />the Village of Mayfield in 1998 as authorized per Ordinance No. 1998- 24 to provide for <br />such stand-by and emergency water service; and <br />WHEREAS, the parties wish to modify such agreement and such modification <br />has been found in the best interest of the health, safety and welfare of all Village <br />residents. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF MAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. The Mayor is hereby and herein authorized and directed to enter <br />into the First Modification to Agreement No. 43125 Between the City of Cleveland and <br />The Lake County Regional Sewer District For Emergency Stand-By Water Service in <br />Mayfield Village in a form comparable to that set forth in Exhibit A, attached hereto and <br />incorporated herein by reference, as and for the providing of stand-by emergency water <br />service. <br />SECTION 2. The Council finds and determines that all formal actions of this <br />Council relating to the adoption of this Ordinance have been taken at open meetings of <br />this Council; and that deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in compliance with all <br />statutory requirements including the requirements of Section 121.22 of the Ohio <br />Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the health, safety and welfare of the residents of Mayfield <br />Village, Ohio. It shall, therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to Council and approval by the <br />Mayor or otherwise at the earliest time allowed by law. <br />
