ORDINANCE NO. 95-04 <br />INTRODUCED BY: Mayor Rinker and Council as a Whole <br />AN EMERGENCY ORDINANCE <br />AUTHORIZING AN AMENDMENT TO THE AGREEMENT <br />WITH THE FRATERNAL ORDER OF POLICE, LODGE NO. 57, <br />HAYFIELD VILLAGE DIVISION, RELATIVE TO ARTICLE 31, <br />EDUCATIONAL BENEFITS <br />WHEREAS, the language of Article 31 in the contract indicates <br />a payout of this benefit in May and September of each calendar <br />year, and the past practice has been to have this payment made in <br />January and July; and <br />WHEREAS, the Director of Finance is not making the January <br />payment in light of the new contract payment, leaving the six month <br />period from 1994 unpaid until May of 1995; and <br />WHEREAS, the Director of Finance and the FOP are in agreement <br />to change the months of payment to reflect the past policy and past <br />payment dates. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF HAYFIELD <br />VILLAGE, OHIO, THAT: <br />SECTION 1. That Article 31 of the contract entered into by <br />the Village of Mayfield and the FOP, under Ordinance No. 94-57, is <br />hereby and herein amended as indicated in Exhibit "A" attached <br />hereto and incorporated herein by reference. <br />SECTION 2. The Council finds and determines that all formal <br />actions of this Council relating to the adoption of this Ordinance <br />have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in <br />such formal action, took place in meetings open to the public, in <br />compliance with all statutory requirements including the <br />requirements of Section 121.22 of the Ohio Revised Code. <br />SECTION 3. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the health, safety and <br />welfare of the residents of Mayfield Village, Ohio, and for the <br />further reasons set forth in the preamble hereof. It shall, <br />therefore, take effect immediately upon the passage by the <br />affirmative vote of not less than five (5) members elected to <br />Council and approval by the Mayor or otherwise at the earliest time <br />allowed by law. <br />MARK FIXL , <br />Council President <br />First Reading: Fehriiar~ 2n 1995 <br />-__, <br />Second Reading: mended , 1995 <br />~' Third Reading: SLGnended , 1995 <br />
